Dutch National Sentenced to 10 Years for Child Exploitation in Kenya

A 73-year-old Dutch national has been sentenced to 10 years in prison for multiple counts including child pornography, sexual communication with minors, indecent acts, and child abuse. Found guilty of soliciting minors for sexual acts and encouraging others to partake in similar behaviors, the court imposed a substantial fine and mandated deportation after the sentence. A 73-year-old Dutch national has been sentenced to 10 years in prison by the Milimani Children’s Court after being found guilty on multiple charges including child pornography, sexual communication with a minor, indecent acts with a child, and child abuse. The accused was convicted on 10 counts, which included six counts of child pornography, two counts of sexual communication with a child, one count of committing an indecent act, and one count of child abuse, as stated by the Office of the Director of Public Prosecution (ODPP).

The prosecution demonstrated that the suspect had purposely exposed a 17-year-old minor to obscene audiovisual materials via WhatsApp, aiming to entice the minor to participate in sexual acts. Additionally, he was found guilty of encouraging a 16-year-old minor to engage in sexual communication with him. The court revealed that the accused had also unlawfully and indecently touched the private parts of the same minor, committing sexual abuse in the presence of the child’s mother who was also in the room.

The court further established that the accused actively incited another individual, referred to as PW3, to perform sexual acts with underage girls, instructing him to capture nude photographs and videos during these incidents, which were subsequently sent to the accused. These offenses were committed between April 2022 and November 2023, according to the ODPP.

Honorable Judge Alice Macharia commented on the proceedings, noting, “As the court of first instance, having heard this matter from the onset, and having observed the demeanor of the accused person and all witnesses… this court finds that the prosecution adduced overwhelming evidence in support of all 10 counts.” Besides the prison term, the suspect has been ordered to pay Ksh3 Million in restitution to the victims. The court also mandated that upon completing his prison sentence, the suspect will be deported. The hearing featured testimony from nine witnesses, reinforcing the prosecution’s case.
